Bar Council of Tamil Nadu & Puducherry Bars practice of two malpractice lawyers, working as full time employee

The Tamil Nadu and Puducherry Bar Council issued restraining orders against two lawyers for malpractice and removal for being a full-time employee, respectively.

By a notification dated 15e December, the Council hinted about a resolution passed against lawyer E. Vimal Kumar under section 35 of the Law on Lawyers, for professional misconduct and the like.

The Council had received a complaint against the said lawyer for fraud and death threats against a woman and her intellectually disabled son. In her complaint, the woman alleged that lawyer Kumar had acquired many golden rulers from her, attempted to abuse her property documents and forged her husband’s signature.

Following the registration of the complaint, the notification from the Bar Association indicates that the lawyer entered the premises of the Bar Association of Poonamallee with another lawyer on 2sd September intoxicated and wreaked havoc on Association premises inside the court campus.

The notification also notes that the accused lawyer, now banned from practicing, verbally assaulted the secretary of the Association and other people present at the time. He had also mistreated the president of the bar council and made death threats. He even continued to physically attack and injure the secretary while endangering his life, the notification adds as a ground for the ban.

The disciplinary measure was taken while keeping in mind that a criminal case is pending against the said lawyer following the complaint filed by the secretary of the association at the police station in Poonamallee, Chennai. The accused was registered for offenses under section 294 (b) [utters any obscene words in or near a public place], 323 [voluntarily causing hurt] and 506 (i) [criminal intimidation] of the CPI.

Another lawyer, B. Ilayaraja, was prosecuted on the grounds that he obtained his law degree while working as a full-time employee at the Tamil Nadu State Marketing Corporation (TASMAC). According to the notification, he joined the bar in 2013 removing the fact that he still works as a full-time employee at TASMAC.
